PRIVACY POLICY & TERMS OF SERVICE

”THE SORORITY” is a trademark registered with the INPI under No. 4556884.

 

THE SORORITY is an initiative and application conceived and developed since March 2019 by its founding team (presented here) within the Purpose-Driven Company THE SORORITY, whose majority shareholder (51%) has been the association THE SORORITY FOUNDATION since April 2021 (the association was created in March 2021). The remaining shares are held by members of the founding team.

 

The THE SORORITY application is made available, free of charge, by THE SORORITY (Purpose-Driven Company) to the benefit of the association THE SORORITY FOUNDATION, in order to achieve the mutually agreed objectives: the fight against domestic and intrafamily violence, against all forms of harassment, and for gender equality.

 

The data collected are solely intended for the functioning of the application and will never be sold or distributed.

 

The Purpose-Driven Company THE SORORITY is a simplified joint-stock company with a capital of €1,000, whose registered office is located at 128 rue la Boétie, 75008 Paris, France, registered with the Paris Trade and Companies Register under No. 853 914 422 (hereinafter referred to as the “Purpose-Driven Company”).

 

THE SORORITY FOUNDATION is a non-profit association (loi 1901) recognized as being of public interest through a rescript dated 08/12/2021, whose registered office is located at 229 rue Saint-Honoré, 75001 Paris, France, registered with the RNA under identification number W751260228 (SIRET: 90365367300025).

 

The association THE SORORITY FOUNDATION is the majority shareholder (51%) of the Purpose-Driven Company THE SORORITY, the entity historically behind the project, the creation of the application, and the THE SORORITY community.

 

By using the Application (as defined below), each user declares that they fully accept these Terms of Use (hereinafter referred to as the “Terms”). They therefore declare and acknowledge that they have read and understood the provisions of these Terms. At any time, if a user disagrees with any of the clauses of the Terms, they must immediately cease using the Application.

 

These Terms define the legal framework for the use of the Application and the relationship that may arise between the Purpose-Driven Company and users. These Terms also contain information relating to users’ rights and the restrictions imposed on those rights by laws or regulations.

 

Each user must refer to the most recent version of these Terms, available at: www.jointhesorority.com

 

The THE SORORITY application is published by the Purpose-Driven Company THE SORORITY. It is hosted by Google Cloud in France.

 

The Application is made available, free of charge, under a contract established for the execution of its mission of support, mutual aid, and safety—fighting all forms of violence, isolation, and (cyber)harassment, and promoting actions in favor of the protection of individuals and gender equality—for the benefit of the non-profit association THE SORORITY FOUNDATION. Through this gratuitous provision contract, the association is authorized to ensure the operational maintenance of the application and to apply any updates or evolutions beneficial to its use and efficiency, under the control and explicit approval of the Purpose-Driven Company.

ARTICLE 1: DEFINITIONS

In these Terms of Use, words or expressions beginning with a capital letter shall have the following meaning:

 

  • Application: refers to the mobile application THE SORORITY designed, developed, and operated by the purpose-driven company THE SORORITY and made available to users;

  • Content: refers to any text, graphic, image, music, video, or other element that may be uploaded by a user or by the purpose-driven company and accessible to other users;

  • Personal Data: refers to personal data within the meaning of the European regulation on the protection of personal data, collected, transmitted, or processed by the purpose-driven company, allowing the identification of, or making identifiable, any natural person;

  • Intellectual Property Rights: refers to all literary and artistic property rights (copyright and related rights), industrial property rights (trademark, design, and patent) provided for in the Intellectual Property Code and international treaties;

  • Law Enforcement Authorities: refers to the police and/or gendarmerie institutions and personnel responsible for maintaining public order and enforcing the law;

  • Services: refers to all functionalities accessible via the Application and offered by the purpose-driven company, as described in these Terms of Use;

  • Support Organizations: refers to any support and aid organization intended for women victims of assault;

  • Users: refers to any person who uses the Application or all or part of the Services offered by the purpose-driven company

 

 

 

ARTICLE 2: PURPOSE AND SCOPE

 

The Purpose-Driven Company allows users to report, through the use of a geolocation system integrated into the Application, the occurrence of an event that may affect the physical or moral integrity of one or more users.

 

The Purpose-Driven Company operates the Application, which enables users to get in touch, communicate, and share Content with other users of the Application.

 

Support Services are accessible through the Application published by the Purpose-Driven Company and the non-profit association recognized as being of public interest, under the supervision and approval of the Purpose-Driven Company.

 

In the event of temporary or prolonged unavailability of the Application, the Purpose-Driven Company shall not be held liable for damages other than those resulting directly or indirectly from the non-performance of its obligations listed herein.

 

 

ARTICLE 3: ENTRY INTO FORCE – DURATION

 

These Terms of Use apply for the entire duration of use of the Application.

 

The Purpose-Driven Company reserves the right to amend the Terms at any time. Any modification takes effect upon its publication. The user agrees to be informed of updates through such publication.

 

By continuing to use the Application after the effective date of the updated Terms, the user acknowledges having read and accepted them. These Terms govern any disputes arising before the effective date of the updated Terms.

 

The latest version of the Terms available online shall prevail over any other version.

 

Any natural person may download and install the Application from the App Store, Google Play Store, or Huawei Store on a compatible mobile device. Access to the Services requires acceptance of these Terms electronically.

 

 

ARTICLE 4: PRIOR INFORMATION

 

The Application may contain hyperlinks to third-party websites or applications. Images and comments on the Application may also include links to third-party applications. The Application also includes third-party content not controlled, managed, or endorsed by the Purpose-Driven Company. As such, the Purpose-Driven Company cannot be held liable for these features or third-party websites.

 

Correspondence and commercial transactions with third parties found through the Application are solely between the user and those third parties.

 

By using such third-party applications, the user acknowledges and agrees that:

 

  • If the user uses a third-party application to share information, they consent to profile data being shared;

  • The use of a third-party application may result in the disclosure of personally identifiable information about the user, even if the Purpose-Driven Company did not itself provide such information;

  • The user uses third-party applications voluntarily and at their own risk and releases the Purpose-Driven Company from liability in case of issues related to third-party applications.

 

 

ARTICLE 5: USER ACCOUNT

 

Browsing the Application is free of charge.

 

To access all functionalities of the Application, the user must create an account (hereinafter referred to as the “User Account”).

 

By creating their Account, the user guarantees that they will protect their Account information and remain fully responsible for any use of it by themselves or third parties.

 

To finalize validation of their Account, the user must provide the following information via the “My Profile” interface:

 

  • Username;

  • First and last name;

  • Password;

  • Email address;

  • Upload of an identity document (front/back);

  • A facial photograph (selfie).

 

For minors aged 12 to 15: in compliance with the law on digital majority, submission of a signed authorization form from a legal representative, along with their ID and email address.

 

For minors aged 15 to 18: in compliance with the law on digital majority, submission of the legal representative’s email address.

 

For cisgender men who are victims of violence or wish to help: a parallel, dedicated, and secure access (segregated access) is available upon receiving three additional sponsorship links.

 

The Purpose-Driven Company reserves the right to refuse the creation of an Account for any reason, without being required to justify its decision. An informational email will always be sent in case of refusal or request for clarification.

 

The Application allows users to modify their Account information at any time.

 

The information provided by the user during account creation is made public to other users of the Application, except for the identity document and selfie, which are deleted from the databases once the account is validated.

 

In case of non-compliance with these Terms, the Purpose-Driven Company reserves the right to modify or terminate access to the Account and the Application at any time, without notice and without liability to the user. In such a case, published Content will no longer be accessible.

 

 

ARTICLE 6: SERVICES

 

6.1 Alert System

The Purpose-Driven Company provides the user with an alert system (“Alert System”) enabling them, by activating a visual and/or audible alert button, to notify other users of the occurrence of an event they deem necessary to share on the Application.

By allowing the Purpose-Driven Company to access their location information, the user may, through the Alert System, share their geographic location and Account information with other users located within a radius configurable from their Account.

Users within this radius are thus instantly informed of the geographic position and identity of the user making use of the Alert System.

The Purpose-Driven Company offers users a “Search” function via the Platform, allowing them to look up another user on the Platform without territorial limitation.

 

6.2 Connection with Law Enforcement and Support Organizations

The Application also provides users with a system facilitating quick contact with Law Enforcement and Support Organizations and allowing direct access to their contact details (proactive and rapid support from the community in case of immediate danger and when the person in danger cannot freely contact authorities by phone—for example, in situations of domestic violence).

The user undertakes to make proportionate use of this Service.

In case of imminent danger, the Purpose-Driven Company recommends that users contact Law Enforcement as a priority and as soon as possible. Users are strongly encouraged not to undertake any action likely to endanger their own safety and physical and moral integrity or that of third parties.

The Purpose-Driven Company reminds users that the Application and its Services can in no way substitute for the action of Law Enforcement.

 

6.3 Messaging and Content Sharing

The Purpose-Driven Company provides an instant messaging interface enabling users to communicate with each other.

Users may share Content of various kinds with other users from their Account. Published Content appears on each user’s personal news feed.

Users may also access a search bar enabling them to search among Content published on the Application according to their own criteria, contact other users, associations, Support Organizations and corresponding entities, and learn about events organized around them.

 

 

ARTICLE 7: DISCLAIMER

 

The Purpose-Driven Company has no obligation to pre-screen, monitor, or modify information published. The Purpose-Driven Company shall not be responsible for choices made by a user.

In no event shall the Purpose-Driven Company, its subsidiaries or affiliates, or any of their employees, officers, directors, agents, resellers, third-party content providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to: (i) the user’s use of the Application; (ii) the user’s inability to use the Application; (iii) the modification or deletion of Content transmitted via the Application; or (iv) these Terms of Use.

The Purpose-Driven Company does not warrant that the Application or Services will meet the user’s needs; that access to and use of the Application and Services will be continuous, fast, and error-free; that results obtained from use will be accurate and reliable; that the quality of services, information, or other content obtained via the Application or Services will meet expectations; or that all errors in the Application and/or Services will be corrected.

The Purpose-Driven Company shall in no case assume any responsibility for relationships that may be formed between victims of violence and persons offering help and support, nor for any consequences that may result. In particular, it shall not be liable for the non-application or misapplication of legal, regulatory, or contractual rules applicable, where relevant, to relationships between victims and helpers.

Likewise, the Purpose-Driven Company shall not be liable for non-compliance by victims and helpers with provisions of any agreements concluded between them.

No information or advice, whether written or oral, obtained by the user from the Purpose-Driven Company or via the Application or Services shall create any warranty not expressly stated in these Terms.

 

 

ARTICLE 8: USER OBLIGATIONS

 

Users undertake, for the entire duration of their use of the Services, to comply with applicable laws and regulations and not to infringe third-party rights or public order. They are solely responsible for content published and opinions expressed; the Purpose-Driven Company’s liability cannot be engaged.

Accordingly, the user undertakes notably:

 

  • not to publish or disseminate any photograph and/or video likely to be considered obscene, pornographic, indecent, harmful, or offensive to the dignity of any human being;

  • not to publish any content, message, or information that is coarse, insulting, or that encourages any activity prohibited by applicable law or regulation;

  • not to publish any photograph and/or video protected by intellectual property law unless they hold the rights or the necessary consent;

  • not to publish any content containing a corrupted file;

  • not to publish any content infringing a third party’s rights;

  • not to cause harm or engage in malicious acts toward other users.

 

The user also undertakes not to transmit:

 

  • incorrect or false information;

  • any sensitive information relating to racial or ethnic origin, political, philosophical, or religious opinions, trade-union membership, sexual life, or health, contrary to good morals and the law.

 

In case of a breach of these rules, the Purpose-Driven Company reserves the right to delete the offending content without notice and, where applicable, the user’s Account.

Users are reminded that any false report to judicial authorities, false declaration, or abusive report may be subject to criminal penalties under Articles 434-26, 441-1, and 226-10 of the French Criminal Code.

Users shall ensure that all information communicated on the Application remains accurate and shall refrain from creating or using, unless authorized, other Accounts under their own identity and/or that of a third party; any identity theft is subject to prosecution and criminal penalties, and any breach may result in immediate suspension of the user’s Account without notice.

 

The user further warrants that they:

 

  • are the sole owner of the content they publish, are able to publish it, and have standing to grant the Purpose-Driven Company a license to distribute it;

  • do not, by their publication, infringe any protected rights, whether personality rights or those provided by the Civil Code and the Intellectual Property Code (copyright, related rights, trademark, patents, image rights, etc.);

  • do not publish false information;

  • do not use content that is likely: to harass third parties or incite others to do so; to incite hatred, discrimination, racism, bigotry, or physical violence; to depict pornography, pedophilia, or any other shocking subject or link to adult sites; to solicit personal information from minors; to solicit funds to finance unlawful activities; to provide phone/fax numbers, street names, names, postal or email addresses; to depict or advocate illegal activities or defamatory, insulting, obscene, threatening, or slanderous behavior, or false/misleading information; to offer illegal or unauthorized copies of works protected by copyright, patents, or trademarks; to encourage mass unsolicited emails/messages or spam; to encourage criminal activity or provide instructions for illegal activities, privacy breaches, virus distribution/creation; to solicit passwords or personal information from other users for unlawful commercial purposes; to involve commercial activities/sales (contests, lotteries, exchanges, ads, pyramid schemes) without the Purpose-Driven Company’s written consent;

  • and will not distribute, reproduce, publish, or modify in any way elements protected by third-party intellectual property rights without prior consent.

 

Any breach by a User may be reported by other Users to: contact@jointhesorority.com.

 

 

ARTICLE 9: MINOR USERS

For legal reasons, THE SORORITY does not offer its Services to users under 12; access is blocked at account creation if the declared age is under 12.

Users under 18 declare they are emancipated minors or have obtained parental/guardian consent to accept these Terms.

Aged 12–15: in addition to Article 5 information, a signed authorization from the legal representative, their ID, and email address; without all elements, the profile will be refused (email notice with reasons).

Over 15: in addition to Article 5 information, the email address of a parent/guardian, whom THE SORORITY may contact if needed; access may be suspended pending the legal representative’s response.

Use of Services by minors over 15 occurs under parental/guardian responsibility. THE SORORITY warns holders of parental authority about the diversity of online content, some of which may offend minors’ sensibilities, and recommends supervising minors’ online activities and ensuring they do not disclose personal data without prior consent.

 

 

ARTICLE 10: INTELLECTUAL PROPERTY RIGHTS

 

“THE SORORITY” is a trademark registered with the INPI.

All such intellectual creations are protected under copyright, trademark, patent, database sui generis rights, and image rights worldwide.

Subject to potentially stricter provisions, only private and/or professional use of the Application is authorized; any other use constitutes infringement unless previously authorized in writing by the Purpose-Driven Company.

Any total or partial copying, scraping, or reproduction of the Application or its Content is strictly prohibited without prior written consent.

 

 

ARTICLE 11: PERSONAL DATA PROTECTION

 

The Purpose-Driven Company undertakes to comply with applicable personal data protection regulations, including EU Regulation 2016/679 (GDPR).

On first connection, the user expressly consents to processing of their Personal Data strictly necessary for the proper functioning of the Application.

Providing personal information under these Terms is mandatory; failure prevents proper provision of Services.

The user acknowledges Personal Data may be transferred or stored outside the country where the Purpose-Driven Company and/or authorized users are located, to perform the Services (hosting and backups in France).

For users in the EEA, Personal Data may be transferred or stored outside the EEA to perform Services (global mutual aid without geographic limitation: map, profiles, exchanges, etc.).

The Purpose-Driven Company implements technical and organizational measures for Data Protection by design and by default, and commits to data minimization.

The user must ensure they are entitled to transfer Personal Data so the Purpose-Driven Company may lawfully use, process, and transfer it on their behalf under these Terms, and that third parties have been informed and have consented where applicable.

Data are collected only under these Terms and any lawful and reasonable instruction from the user.

Upon detecting a rights violation in processing Personal Data, it shall be notified to competent authorities upon evidence collection in the context of a criminal complaint and to the CNIL within no more than 72 hours after becoming aware.

Any breach relating to a user’s Personal Data shall be notified to the user by email as soon as possible (upon becoming aware).

Each party shall take appropriate technical and organizational measures against unauthorized/illegal processing and against accidental loss, destruction, or damage.

 

11.1 Use and transmission of Personal Data

 

Data are processed to: create an Account; manage the profile; publish/share anonymized Content; geolocation information in danger situations (sending/receiving alerts); search for other users/entities via the Platform for help/support.

Data may also be used to strengthen and personalize communications (newsletters), tailor the Application to user preferences, and offer suitable services.

Consolidated statistics (no personal data) may be shared with partners; data may be sent to technical providers solely to perform services.

Personal data will be destroyed no later than six months after Account deletion. Some data may be retained to evidence proper contractual/legal performance, limited to what is strictly necessary.

Data are deleted immediately upon Account deletion within the app (Menu > Settings & Privacy > Unsubscribe). If requested by email (dpo@jointhesorority.com or contact@jointhesorority.com), deletion is processed as soon as the teams become aware. The Purpose-Driven Company retains no personal data once the profile is deleted.

 

11.2 Newsletters

Upon registration validation, the user acknowledges the Terms and accepts that THE SORORITY may send a newsletter. Users can unsubscribe via the link in each email.

 

11.3 Rights of access, rectification, objection, and deletion

 

In all cases, the user has the right of access, rectification, objection, and erasure of their personal data by following the detailed processes below:

 

Request to modify data

 

Directly in the Application:

 

Menu › Profile › Edit profile.

 

All fields can be modified at any time, except for the user’s email address.

 

Special Case 1 – Change of email address (to ensure rapid identification in case of malicious profile/behavior):

 

To change the email address, an explicit request must be sent to dpo@jointhesorority.com or contact@jointhesorority.com, specifying:

 

  • the previous email address used, and

  • the new email address requested.

 

For the request to be valid and executed, it must be sent from one of these two addresses (old or new).

 

Special Case 2 – Change of date of birth (to ensure compliance with the digital age of majority law):

 

To change the date of birth, an explicit request must be sent to dpo@jointhesorority.com or contact@jointhesorority.com, specifying:

 

  • the desired change of date of birth, and

  • the identity document showing the date of birth to be changed.

 

For the request to be valid and executed, it must be sent from the email address of the active account.

 

Processing times:

 

  • Modifications are effective immediately after validation in the Application (Profile screen).

  • The change of email address and/or date of birth is processed as soon as possible from the time the internal team becomes aware of the request (maximum 2 months).

 

This measure ensures profile traceability (immediate identification of any malicious profile or behavior that may result in banning of the profile).

 

Request to delete the account and data

 

Directly in the Application:

 

Menu › Settings & Privacy › Unsubscribe.

 

A notification email is sent immediately to confirm the total deletion of all personal information linked to the profile.

 

By email:

 

  • To dpo@jointhesorority.com, indicating full name, email, and address.

  • Requests sent to contact@jointhesorority.com are also processed as soon as possible (from the time of acknowledgment — maximum 2 months).

  • Execution of the deletion is notified by email as soon as it is effective.

 

Data retention

 

Personal Data collected through the use of the Application is retained only for the time strictly necessary for its operation and until the user’s account is permanently deleted.

 

Selfies and ID documents provided during registration are immediately and permanently deleted once profile moderation is completed, whether validated or refused.

 

Special Case 1: Awaiting user response during moderation

 

If the ID document submitted at registration cannot be reviewed, the profile is placed on hold.

 

  • Personal information provided is then retained for a maximum of one (1) month.

  • Without response from the user and without completion of moderation within this period, all information is automatically and permanently deleted.

 

Special Case 2: Awaiting exchange with partner association Transaide during moderation

 

When validation of a profile requires prior exchange with our partner association Transaide (contact@transaide.org)—notably in the following cases to ensure full safety and adapted support:

 

  • people from gender minorities,

  • cis men who mistakenly selected non-mixed access,

  • cis men attempting to force access to the non-mixed space with malicious intent,

 

then personal data is retained for a maximum of one (1) year.

 

  • A reminder is sent to the registrant after six (6) months without response.

  • Without response by the end of the one (1) year maximum period, all personal data is permanently deleted, without completion of profile moderation. An automatic notification email is sent.

 

The user may retrieve their Personal Data in an open and readable format. The right to portability is limited to data provided by the concerned user. It applies based on the user’s prior consent and only if the profile is still active (all personal data is permanently destroyed upon deletion of the profile). The Company undertakes to transfer, upon request, within one (1) month, any document collecting Personal Data to the user in order to enable the exercise of the right to portability. Costs related to data recovery are borne by the requesting user.

 

11.4 Website and cookie policy

 

The website, hosted on Wix.com Ltd., only presents information about the Company, the Association, and the Application. No personal data transmitted via the Application are integrated or linked there.

 

  • Strictly necessary cookies are placed automatically and require no consent.

  • Other cookies (analytics, functional, marketing) are activated only after explicit consent via a banner; consent can be withdrawn at any time; cookie retention shall not exceed 13 months.

ARTICLE 12: TECHNICAL PROVISIONS

Services are provided “as is” and subject to availability. No guarantee of error-free, uninterrupted, or secure provision. No obligation of personalized (notably technical) assistance. All express or implied warranties (quality, fitness for a particular purpose) are disclaimed. No guarantee of results or benefits. No guarantee against intrusion/corruption/download issues or that information/data circulating on the Internet are protected against attacks or misappropriation.

 

 

ARTICLE 13: SECURITY

 

13.1 General

The user must meet technical requirements to access the Application securely and is fully responsible for their equipment and Internet connection, ensuring appropriate security (AV/anti-spyware/personal firewall) and accepting technical risks (outage, network issues, overload). The Purpose-Driven Company is not liable for Internet access risks or remote data transmission issues (confidentiality, cost, maintenance, interruptions).

 

13.2 Changes and termination of services

 

The user may unsubscribe at any time in-app (Menu > Settings & Privacy > Unsubscribe) or by email (dpo@jointhesorority.com / contact@jointhesorority.com). Confirmation is sent electronically; unsubscription takes effect on the date of confirmation.

In case of breach of these Terms, the Purpose-Driven Company may suspend or terminate access with immediate effect, effective on the date of notification by post or email.

 

 

ARTICLE 14: FORCE MAJEURE

Any event beyond the Purpose-Driven Company’s control and against which it could not reasonably protect constitutes force majeure and suspends obligations (e.g., strikes, technical outages—utilities, telecom operators, ISPs/hosting, registrars—power cuts, failures of electronic communication networks). The Purpose-Driven Company shall not be liable for non-performance due to force majeure, provided it notifies the other party and uses best efforts to minimize harm and resume performance as soon as possible.

 

 

ARTICLE 15: ENTIRE AGREEMENT

 

These Terms constitute the entire agreement between users and the Purpose-Driven Company, superseding any prior/post exchanges, proposals, or conflicting provisions unless amended by a duly signed addendum.

 

 

ARTICLE 16: NO WAIVER

 

Failure by either party to enforce any clause, permanently or temporarily, shall not be deemed a waiver of any rights arising therefrom.

 

 

ARTICLE 17: SEVERABILITY

 

If any provision is held invalid by law/regulation or final court decision, the remaining provisions shall remain in full force. The Purpose-Driven Company undertakes to delete and replace the clause with a valid one immediately.

 

 

ARTICLE 18: HEADINGS

 

In case of interpretation difficulties between headings and the body of any article/clauses, headings shall be deemed not written.

 

 

ARTICLE 19: JURISDICTION – GOVERNING LAW

 

These Terms are governed by French law.

Parties shall endeavor to settle disputes amicably. After at least thirty (30) business days of good-faith negotiations without resolution, the dispute shall be brought before the court with exclusive jurisdiction.

All disputes relating to validity, performance, interpretation, and/or termination of these Terms fall under the exclusive jurisdiction of the courts of Paris, subject to mandatory procedural rules. If any part of this article is found unenforceable, the remaining stipulations shall continue in effect.

Processing necessary for the pursuit of the legitimate interests of the Mission-driven Company:

- Ensure the proper functioning of the Application (map, alerts, notifications in particular)

- Internal team that processes Personal Data, solely within the framework of the operation of the Application and permitted mutual assistance

- Subcontractors, particularly in the areas of technology, online services and data security. Official authorities and law enforcement in the context of a search (disappearance) or investigation.

Health data (disability)

Information as shared by Users on their profile.

Processing necessary for the pursuit of the legitimate interests of the Mission-driven Company:

- Ensure the proper functioning of the Application within the framework of its purpose (taking into consideration certain health issues, such as disability or psychiatric disorders in the event of a request for intervention or support: transmitted to the medical teams and authorities mobilized to ensure appropriate care)

- Internal team that processes Personal Data, solely within the framework of the operation of the Application and permitted mutual assistance

- Subcontractors, particularly in the areas of technology, online services and data security. Official authorities and law enforcement in the context of a search (disappearance) or investigation.

ARTICLE 1: DEFINITIONS

In these Terms of Use, words or expressions beginning with a capital letter shall have the following meaning:

 

  • Application: refers to the mobile application THE SORORITY designed, developed, and operated by the purpose-driven company THE SORORITY and made available to users;

  • Content: refers to any text, graphic, image, music, video, or other element that may be uploaded by a user or by the purpose-driven company and accessible to other users;

  • Personal Data: refers to personal data within the meaning of the European regulation on the protection of personal data, collected, transmitted, or processed by the purpose-driven company, allowing the identification of, or making identifiable, any natural person;

  • Intellectual Property Rights: refers to all literary and artistic property rights (copyright and related rights), industrial property rights (trademark, design, and patent) provided for in the Intellectual Property Code and international treaties;

  • Law Enforcement Authorities: refers to the police and/or gendarmerie institutions and personnel responsible for maintaining public order and enforcing the law;

  • Services: refers to all functionalities accessible via the Application and offered by the purpose-driven company, as described in these Terms of Use;

  • Support Organizations: refers to any support and aid organization intended for women victims of assault;

  • Users: refers to any person who uses the Application or all or part of the Services offered by the purpose-driven company

 

 

 

ARTICLE 2: PURPOSE AND SCOPE

 

The Purpose-Driven Company allows users to report, through the use of a geolocation system integrated into the Application, the occurrence of an event that may affect the physical or moral integrity of one or more users.

 

The Purpose-Driven Company operates the Application, which enables users to get in touch, communicate, and share Content with other users of the Application.

 

Support Services are accessible through the Application published by the Purpose-Driven Company and the non-profit association recognized as being of public interest, under the supervision and approval of the Purpose-Driven Company.

 

In the event of temporary or prolonged unavailability of the Application, the Purpose-Driven Company shall not be held liable for damages other than those resulting directly or indirectly from the non-performance of its obligations listed herein.

 

 

ARTICLE 3: ENTRY INTO FORCE – DURATION

 

These Terms of Use apply for the entire duration of use of the Application.

 

The Purpose-Driven Company reserves the right to amend the Terms at any time. Any modification takes effect upon its publication. The user agrees to be informed of updates through such publication.

 

By continuing to use the Application after the effective date of the updated Terms, the user acknowledges having read and accepted them. These Terms govern any disputes arising before the effective date of the updated Terms.

 

The latest version of the Terms available online shall prevail over any other version.

 

Any natural person may download and install the Application from the App Store, Google Play Store, or Huawei Store on a compatible mobile device. Access to the Services requires acceptance of these Terms electronically.

 

 

ARTICLE 4: PRIOR INFORMATION

 

The Application may contain hyperlinks to third-party websites or applications. Images and comments on the Application may also include links to third-party applications. The Application also includes third-party content not controlled, managed, or endorsed by the Purpose-Driven Company. As such, the Purpose-Driven Company cannot be held liable for these features or third-party websites.

 

Correspondence and commercial transactions with third parties found through the Application are solely between the user and those third parties.

 

By using such third-party applications, the user acknowledges and agrees that:

 

  • If the user uses a third-party application to share information, they consent to profile data being shared;

  • The use of a third-party application may result in the disclosure of personally identifiable information about the user, even if the Purpose-Driven Company did not itself provide such information;

  • The user uses third-party applications voluntarily and at their own risk and releases the Purpose-Driven Company from liability in case of issues related to third-party applications.

 

 

ARTICLE 5: USER ACCOUNT

 

Browsing the Application is free of charge.

 

To access all functionalities of the Application, the user must create an account (hereinafter referred to as the “User Account”).

 

By creating their Account, the user guarantees that they will protect their Account information and remain fully responsible for any use of it by themselves or third parties.

 

To finalize validation of their Account, the user must provide the following information via the “My Profile” interface:

 

  • Username;

  • First and last name;

  • Password;

  • Email address;

  • Upload of an identity document (front/back);

  • A facial photograph (selfie).

 

For minors aged 12 to 15: in compliance with the law on digital majority, submission of a signed authorization form from a legal representative, along with their ID and email address.

 

For minors aged 15 to 18: in compliance with the law on digital majority, submission of the legal representative’s email address.

 

For cisgender men who are victims of violence or wish to help: a parallel, dedicated, and secure access (segregated access) is available upon receiving three additional sponsorship links.

 

The Purpose-Driven Company reserves the right to refuse the creation of an Account for any reason, without being required to justify its decision. An informational email will always be sent in case of refusal or request for clarification.

 

The Application allows users to modify their Account information at any time.

 

The information provided by the user during account creation is made public to other users of the Application, except for the identity document and selfie, which are deleted from the databases once the account is validated.

 

In case of non-compliance with these Terms, the Purpose-Driven Company reserves the right to modify or terminate access to the Account and the Application at any time, without notice and without liability to the user. In such a case, published Content will no longer be accessible.

 

 

ARTICLE 6: SERVICES

 

6.1 Alert System

The Purpose-Driven Company provides the user with an alert system (“Alert System”) enabling them, by activating a visual and/or audible alert button, to notify other users of the occurrence of an event they deem necessary to share on the Application.

By allowing the Purpose-Driven Company to access their location information, the user may, through the Alert System, share their geographic location and Account information with other users located within a radius configurable from their Account.

Users within this radius are thus instantly informed of the geographic position and identity of the user making use of the Alert System.

The Purpose-Driven Company offers users a “Search” function via the Platform, allowing them to look up another user on the Platform without territorial limitation.

 

6.2 Connection with Law Enforcement and Support Organizations

The Application also provides users with a system facilitating quick contact with Law Enforcement and Support Organizations and allowing direct access to their contact details (proactive and rapid support from the community in case of immediate danger and when the person in danger cannot freely contact authorities by phone—for example, in situations of domestic violence).

The user undertakes to make proportionate use of this Service.

In case of imminent danger, the Purpose-Driven Company recommends that users contact Law Enforcement as a priority and as soon as possible. Users are strongly encouraged not to undertake any action likely to endanger their own safety and physical and moral integrity or that of third parties.

The Purpose-Driven Company reminds users that the Application and its Services can in no way substitute for the action of Law Enforcement.

 

6.3 Messaging and Content Sharing

The Purpose-Driven Company provides an instant messaging interface enabling users to communicate with each other.

Users may share Content of various kinds with other users from their Account. Published Content appears on each user’s personal news feed.

Users may also access a search bar enabling them to search among Content published on the Application according to their own criteria, contact other users, associations, Support Organizations and corresponding entities, and learn about events organized around them.

 

 

ARTICLE 7: DISCLAIMER

 

The Purpose-Driven Company has no obligation to pre-screen, monitor, or modify information published. The Purpose-Driven Company shall not be responsible for choices made by a user.

In no event shall the Purpose-Driven Company, its subsidiaries or affiliates, or any of their employees, officers, directors, agents, resellers, third-party content providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to: (i) the user’s use of the Application; (ii) the user’s inability to use the Application; (iii) the modification or deletion of Content transmitted via the Application; or (iv) these Terms of Use.

The Purpose-Driven Company does not warrant that the Application or Services will meet the user’s needs; that access to and use of the Application and Services will be continuous, fast, and error-free; that results obtained from use will be accurate and reliable; that the quality of services, information, or other content obtained via the Application or Services will meet expectations; or that all errors in the Application and/or Services will be corrected.

The Purpose-Driven Company shall in no case assume any responsibility for relationships that may be formed between victims of violence and persons offering help and support, nor for any consequences that may result. In particular, it shall not be liable for the non-application or misapplication of legal, regulatory, or contractual rules applicable, where relevant, to relationships between victims and helpers.

Likewise, the Purpose-Driven Company shall not be liable for non-compliance by victims and helpers with provisions of any agreements concluded between them.

No information or advice, whether written or oral, obtained by the user from the Purpose-Driven Company or via the Application or Services shall create any warranty not expressly stated in these Terms.

 

 

ARTICLE 8: USER OBLIGATIONS

 

Users undertake, for the entire duration of their use of the Services, to comply with applicable laws and regulations and not to infringe third-party rights or public order. They are solely responsible for content published and opinions expressed; the Purpose-Driven Company’s liability cannot be engaged.

Accordingly, the user undertakes notably:

 

  • not to publish or disseminate any photograph and/or video likely to be considered obscene, pornographic, indecent, harmful, or offensive to the dignity of any human being;

  • not to publish any content, message, or information that is coarse, insulting, or that encourages any activity prohibited by applicable law or regulation;

  • not to publish any photograph and/or video protected by intellectual property law unless they hold the rights or the necessary consent;

  • not to publish any content containing a corrupted file;

  • not to publish any content infringing a third party’s rights;

  • not to cause harm or engage in malicious acts toward other users.

 

The user also undertakes not to transmit:

 

  • incorrect or false information;

  • any sensitive information relating to racial or ethnic origin, political, philosophical, or religious opinions, trade-union membership, sexual life, or health, contrary to good morals and the law.

 

In case of a breach of these rules, the Purpose-Driven Company reserves the right to delete the offending content without notice and, where applicable, the user’s Account.

Users are reminded that any false report to judicial authorities, false declaration, or abusive report may be subject to criminal penalties under Articles 434-26, 441-1, and 226-10 of the French Criminal Code.

Users shall ensure that all information communicated on the Application remains accurate and shall refrain from creating or using, unless authorized, other Accounts under their own identity and/or that of a third party; any identity theft is subject to prosecution and criminal penalties, and any breach may result in immediate suspension of the user’s Account without notice.

 

The user further warrants that they:

 

  • are the sole owner of the content they publish, are able to publish it, and have standing to grant the Purpose-Driven Company a license to distribute it;

  • do not, by their publication, infringe any protected rights, whether personality rights or those provided by the Civil Code and the Intellectual Property Code (copyright, related rights, trademark, patents, image rights, etc.);

  • do not publish false information;

  • do not use content that is likely: to harass third parties or incite others to do so; to incite hatred, discrimination, racism, bigotry, or physical violence; to depict pornography, pedophilia, or any other shocking subject or link to adult sites; to solicit personal information from minors; to solicit funds to finance unlawful activities; to provide phone/fax numbers, street names, names, postal or email addresses; to depict or advocate illegal activities or defamatory, insulting, obscene, threatening, or slanderous behavior, or false/misleading information; to offer illegal or unauthorized copies of works protected by copyright, patents, or trademarks; to encourage mass unsolicited emails/messages or spam; to encourage criminal activity or provide instructions for illegal activities, privacy breaches, virus distribution/creation; to solicit passwords or personal information from other users for unlawful commercial purposes; to involve commercial activities/sales (contests, lotteries, exchanges, ads, pyramid schemes) without the Purpose-Driven Company’s written consent;

  • and will not distribute, reproduce, publish, or modify in any way elements protected by third-party intellectual property rights without prior consent.

 

Any breach by a User may be reported by other Users to: contact@jointhesorority.com.

 

 

ARTICLE 9: MINOR USERS

For legal reasons, THE SORORITY does not offer its Services to users under 12; access is blocked at account creation if the declared age is under 12.

Users under 18 declare they are emancipated minors or have obtained parental/guardian consent to accept these Terms.

Aged 12–15: in addition to Article 5 information, a signed authorization from the legal representative, their ID, and email address; without all elements, the profile will be refused (email notice with reasons).

Over 15: in addition to Article 5 information, the email address of a parent/guardian, whom THE SORORITY may contact if needed; access may be suspended pending the legal representative’s response.

Use of Services by minors over 15 occurs under parental/guardian responsibility. THE SORORITY warns holders of parental authority about the diversity of online content, some of which may offend minors’ sensibilities, and recommends supervising minors’ online activities and ensuring they do not disclose personal data without prior consent.

 

 

ARTICLE 10: INTELLECTUAL PROPERTY RIGHTS

 

“THE SORORITY” is a trademark registered with the INPI.

All such intellectual creations are protected under copyright, trademark, patent, database sui generis rights, and image rights worldwide.

Subject to potentially stricter provisions, only private and/or professional use of the Application is authorized; any other use constitutes infringement unless previously authorized in writing by the Purpose-Driven Company.

Any total or partial copying, scraping, or reproduction of the Application or its Content is strictly prohibited without prior written consent.

 

 

ARTICLE 11: PERSONAL DATA PROTECTION

 

The Purpose-Driven Company undertakes to comply with applicable personal data protection regulations, including EU Regulation 2016/679 (GDPR).

On first connection, the user expressly consents to processing of their Personal Data strictly necessary for the proper functioning of the Application.

Providing personal information under these Terms is mandatory; failure prevents proper provision of Services.

The user acknowledges Personal Data may be transferred or stored outside the country where the Purpose-Driven Company and/or authorized users are located, to perform the Services (hosting and backups in France).

For users in the EEA, Personal Data may be transferred or stored outside the EEA to perform Services (global mutual aid without geographic limitation: map, profiles, exchanges, etc.).

The Purpose-Driven Company implements technical and organizational measures for Data Protection by design and by default, and commits to data minimization.

The user must ensure they are entitled to transfer Personal Data so the Purpose-Driven Company may lawfully use, process, and transfer it on their behalf under these Terms, and that third parties have been informed and have consented where applicable.

Data are collected only under these Terms and any lawful and reasonable instruction from the user.

Upon detecting a rights violation in processing Personal Data, it shall be notified to competent authorities upon evidence collection in the context of a criminal complaint and to the CNIL within no more than 72 hours after becoming aware.

Any breach relating to a user’s Personal Data shall be notified to the user by email as soon as possible (upon becoming aware).

Each party shall take appropriate technical and organizational measures against unauthorized/illegal processing and against accidental loss, destruction, or damage.

 

11.1 Use and transmission of Personal Data

 

Data are processed to: create an Account; manage the profile; publish/share anonymized Content; geolocation information in danger situations (sending/receiving alerts); search for other users/entities via the Platform for help/support.

Data may also be used to strengthen and personalize communications (newsletters), tailor the Application to user preferences, and offer suitable services.

Consolidated statistics (no personal data) may be shared with partners; data may be sent to technical providers solely to perform services.

Personal data will be destroyed no later than six months after Account deletion. Some data may be retained to evidence proper contractual/legal performance, limited to what is strictly necessary.

Data are deleted immediately upon Account deletion within the app (Menu > Settings & Privacy > Unsubscribe). If requested by email (dpo@jointhesorority.com or contact@jointhesorority.com), deletion is processed as soon as the teams become aware. The Purpose-Driven Company retains no personal data once the profile is deleted.

 

11.2 Newsletters

Upon registration validation, the user acknowledges the Terms and accepts that THE SORORITY may send a newsletter. Users can unsubscribe via the link in each email.

 

11.3 Rights of access, rectification, objection, and deletion

 

In all cases, the user has the right of access, rectification, objection, and erasure of their personal data by following the detailed processes below:

 

Request to modify data

 

Directly in the Application:

 

Menu › Profile › Edit profile.

 

All fields can be modified at any time, except for the user’s email address.

 

Special Case 1 – Change of email address (to ensure rapid identification in case of malicious profile/behavior):

 

To change the email address, an explicit request must be sent to dpo@jointhesorority.com or contact@jointhesorority.com, specifying:

 

  • the previous email address used, and

  • the new email address requested.

 

For the request to be valid and executed, it must be sent from one of these two addresses (old or new).

 

Special Case 2 – Change of date of birth (to ensure compliance with the digital age of majority law):

 

To change the date of birth, an explicit request must be sent to dpo@jointhesorority.com or contact@jointhesorority.com, specifying:

 

  • the desired change of date of birth, and

  • the identity document showing the date of birth to be changed.

 

For the request to be valid and executed, it must be sent from the email address of the active account.

 

Processing times:

 

  • Modifications are effective immediately after validation in the Application (Profile screen).

  • The change of email address and/or date of birth is processed as soon as possible from the time the internal team becomes aware of the request (maximum 2 months).

 

This measure ensures profile traceability (immediate identification of any malicious profile or behavior that may result in banning of the profile).

 

Request to delete the account and data

 

Directly in the Application:

 

Menu › Settings & Privacy › Unsubscribe.

 

A notification email is sent immediately to confirm the total deletion of all personal information linked to the profile.

 

By email:

 

  • To dpo@jointhesorority.com, indicating full name, email, and address.

  • Requests sent to contact@jointhesorority.com are also processed as soon as possible (from the time of acknowledgment — maximum 2 months).

  • Execution of the deletion is notified by email as soon as it is effective.

 

Data retention

 

Personal Data collected through the use of the Application is retained only for the time strictly necessary for its operation and until the user’s account is permanently deleted.

 

Selfies and ID documents provided during registration are immediately and permanently deleted once profile moderation is completed, whether validated or refused.

 

Special Case 1: Awaiting user response during moderation

 

If the ID document submitted at registration cannot be reviewed, the profile is placed on hold.

 

  • Personal information provided is then retained for a maximum of one (1) month.

  • Without response from the user and without completion of moderation within this period, all information is automatically and permanently deleted.

 

Special Case 2: Awaiting exchange with partner association Transaide during moderation

 

When validation of a profile requires prior exchange with our partner association Transaide (contact@transaide.org)—notably in the following cases to ensure full safety and adapted support:

 

  • people from gender minorities,

  • cis men who mistakenly selected non-mixed access,

  • cis men attempting to force access to the non-mixed space with malicious intent,

 

then personal data is retained for a maximum of one (1) year.

 

  • A reminder is sent to the registrant after six (6) months without response.

  • Without response by the end of the one (1) year maximum period, all personal data is permanently deleted, without completion of profile moderation. An automatic notification email is sent.

 

The user may retrieve their Personal Data in an open and readable format. The right to portability is limited to data provided by the concerned user. It applies based on the user’s prior consent and only if the profile is still active (all personal data is permanently destroyed upon deletion of the profile). The Company undertakes to transfer, upon request, within one (1) month, any document collecting Personal Data to the user in order to enable the exercise of the right to portability. Costs related to data recovery are borne by the requesting user.

 

11.4 Website and cookie policy

 

The website, hosted on Wix.com Ltd., only presents information about the Company, the Association, and the Application. No personal data transmitted via the Application are integrated or linked there.

 

  • Strictly necessary cookies are placed automatically and require no consent.

  • Other cookies (analytics, functional, marketing) are activated only after explicit consent via a banner; consent can be withdrawn at any time; cookie retention shall not exceed 13 months.

ARTICLE 12: TECHNICAL PROVISIONS

Services are provided “as is” and subject to availability. No guarantee of error-free, uninterrupted, or secure provision. No obligation of personalized (notably technical) assistance. All express or implied warranties (quality, fitness for a particular purpose) are disclaimed. No guarantee of results or benefits. No guarantee against intrusion/corruption/download issues or that information/data circulating on the Internet are protected against attacks or misappropriation.

 

 

ARTICLE 13: SECURITY

 

13.1 General

The user must meet technical requirements to access the Application securely and is fully responsible for their equipment and Internet connection, ensuring appropriate security (AV/anti-spyware/personal firewall) and accepting technical risks (outage, network issues, overload). The Purpose-Driven Company is not liable for Internet access risks or remote data transmission issues (confidentiality, cost, maintenance, interruptions).

 

13.2 Changes and termination of services

 

The user may unsubscribe at any time in-app (Menu > Settings & Privacy > Unsubscribe) or by email (dpo@jointhesorority.com / contact@jointhesorority.com). Confirmation is sent electronically; unsubscription takes effect on the date of confirmation.

In case of breach of these Terms, the Purpose-Driven Company may suspend or terminate access with immediate effect, effective on the date of notification by post or email.

 

 

ARTICLE 14: FORCE MAJEURE

Any event beyond the Purpose-Driven Company’s control and against which it could not reasonably protect constitutes force majeure and suspends obligations (e.g., strikes, technical outages—utilities, telecom operators, ISPs/hosting, registrars—power cuts, failures of electronic communication networks). The Purpose-Driven Company shall not be liable for non-performance due to force majeure, provided it notifies the other party and uses best efforts to minimize harm and resume performance as soon as possible.

 

 

ARTICLE 15: ENTIRE AGREEMENT

 

These Terms constitute the entire agreement between users and the Purpose-Driven Company, superseding any prior/post exchanges, proposals, or conflicting provisions unless amended by a duly signed addendum.

 

 

ARTICLE 16: NO WAIVER

 

Failure by either party to enforce any clause, permanently or temporarily, shall not be deemed a waiver of any rights arising therefrom.

 

 

ARTICLE 17: SEVERABILITY

 

If any provision is held invalid by law/regulation or final court decision, the remaining provisions shall remain in full force. The Purpose-Driven Company undertakes to delete and replace the clause with a valid one immediately.

 

 

ARTICLE 18: HEADINGS

 

In case of interpretation difficulties between headings and the body of any article/clauses, headings shall be deemed not written.

 

 

ARTICLE 19: JURISDICTION – GOVERNING LAW

 

These Terms are governed by French law.

Parties shall endeavor to settle disputes amicably. After at least thirty (30) business days of good-faith negotiations without resolution, the dispute shall be brought before the court with exclusive jurisdiction.

All disputes relating to validity, performance, interpretation, and/or termination of these Terms fall under the exclusive jurisdiction of the courts of Paris, subject to mandatory procedural rules. If any part of this article is found unenforceable, the remaining stipulations shall continue in effect.
