The purpose of these General Conditions of Use (hereinafter "GCU") is to define the terms of access and use of this website.

The purpose of these General Terms of Use (hereinafter "GTU") is to define the terms of access and use of the website www.jointhesorority.com (hereinafter "the Site"). By accessing the Site, the user unreservedly accepts these GTU.

 

THE SORORITY is an initiative and application imagined and developed since March 2019 by its founding team ( Presented here) within the Mission Company THE SORORITY, whose majority shareholder (51%) is the association THE SORORITY FOUNDATION, since April 2021 (creation of the association in March 2021). The remaining shares are held by the members of its founding team.

 

The Mission-Driven Company THE SORORITY is a simplified joint-stock company with a capital of 1,000 euros, whose registered office is located at 128 rue la Boétie, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 853 914 422 (hereinafter referred to as the “Mission-Driven Company”).

 

THE SORORITY FOUNDATION is an association under the 1901 law recognized as being of general interest via rescript dated 08/12/21, whose head office is located at 229 rue Saint-Honoré 75001 Paris, France, registered in the RNA Register under identification number W751260228 (SIRET: 90365367300025).

 

The association THE SORORITY FOUNDATION is the majority shareholder (51%) of the mission-driven company THE SORORITY, the entity historically behind the project, the creation of the application and the THE SORORITY community.

The Site is published by the mission-driven company THE SORORITY. It is hosted on the Wix.com Ltd platform.

ARTICLE 1: DEFINITIONS

In these Terms of Use, words or expressions beginning with a capital letter have the following meaning:

  • Site: refers to the website www.jointhesorority.com;

  • Personal Data: refers to personal data within the meaning of the General Data Protection Regulation that the Purpose-Driven Company collects, transmits, or processes, allowing the identification or making identifiable of any natural person;

  • Content: refers to any text, graphic, image, music, video, or other element that may be uploaded to the Site by the Purpose-Driven Company;

  • Intellectual Property Rights: refers to all literary and artistic property rights (copyright and related rights), industrial property rights (trademark, design and model, and patent) provided for in the French Intellectual Property Code and international treaties;

  • Services: refers to all the functionalities accessible through the Site offered by the Purpose-Driven Company, as described in these Terms of Use;

  • User: refers to any person who uses the Website or all or part of the Services offered by the Purpose-Driven Company.

The Site is freely accessible to any User with internet access.

 

The Purpose-Driven Company implements reasonable means to ensure quality access but does not guarantee that the Site will be available at all times, without interruption or error.

 

The Site may contain hyperlinks redirecting to third-party websites or applications. The Purpose-Driven Company cannot be held responsible for these third-party features or websites.

 

 

ARTICLE 3: USE OF THE SITE

 

The User agrees to use the Site in accordance with the law and these Terms of Use.

“THE SORORITY” is a registered trademark with the INPI.

 

All content on the Site (texts, images, logos, graphics, etc.) is protected by intellectual property law and remains the exclusive property of the publisher or its partners.

 

Any reproduction, representation, modification, or distribution, in whole or in part, is prohibited without prior authorization.

 

 

ARTICLE 6: PERSONAL DATA

 

The Purpose-Driven Company undertakes to comply with the regulations applicable to the protection of Personal Data, in particular the obligations arising from European Regulation No. 2016/679 on the protection of Personal Data (GDPR).

 

The User may only provide their own Personal Data so that the Purpose-Driven Company can lawfully use and process such data in accordance with these Terms and Conditions.

 

The Purpose-Driven Company collects Personal Data solely in compliance with the provisions of these Terms and any lawful and reasonable instructions that the User may provide at any time.

 

6.1 Use and Transmission of Personal Data

 

To ensure the operation of certain features of the Site, the Purpose-Driven Company may process the User’s Personal Data.

 

The Purpose-Driven Company applies the principles of data protection by design and by default, ensuring that only the necessary Personal Data is processed and properly protected. The Purpose-Driven Company commits to limiting the amount of Personal Data processed from the outset.

The provision of the personal information collected under these Terms is mandatory. This information is necessary for the proper functioning of the Services requested by the User.

 

The Purpose-Driven Company may also use the User’s data to strengthen and personalize its communication, in particular through newsletters/emails, and to offer Services tailored to the expectations of Users and the countries concerned.

 

6.2 Retention of Personal Data

 

The Purpose-Driven Company implements all necessary technical and organizational measures to protect Personal Data against any unauthorized, inappropriate, or unlawful access, use, disclosure, alteration, or destruction, in accordance with applicable data protection laws.

 

Personal Data collected in the context of using the Site are retained only for the period strictly necessary for its operation.

 

 

6.3 Transfer of Personal Data

 

The Site’s database is hosted and backed up in Europe; Wix is compliant and certified ISO 27001 / 27701:

The User acknowledges and agrees that Personal Data may be transferred or stored outside the country where the Purpose-Driven Company and/or authorized Users are located, for the purpose of executing the Services provided under these Terms, such as the storage of certain data.

 

For Users located in the European Economic Area (hereinafter the “EEA”), the User acknowledges and agrees that Personal Data may be transferred or stored outside the EEA, for the purpose of executing the Services provided under these Terms (international mutual aid without geographical limitation: alert, map, profiles, exchanges, etc.). Personal Data are then transferred outside the EEA in accordance with applicable personal data protection laws and regulations.

 

 

6.4 Rights of Access, Modification, Deletion, and Portability

 

The User has rights over their Personal Data, including the rights of access, modification, deletion, and portability, which they may exercise by writing to dpo@jointhesorority.com.

 

The User also has the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL) at the following address:

6.5 Website and Cookie Management Policy

 

The Site, hosted on the Wix.com Ltd. platform, is solely intended to present information relating to the actions of the Purpose-Driven Company, the Association, and the Application. No Personal Data transmitted via the THE SORORITY application is integrated into or linked to it.

 

  • Strictly necessary cookies are placed automatically and do not require consent.

  • Other cookies (analytics, functional, marketing) are activated only after the User’s explicit consent, collected via an information banner.

  • Consent may be withdrawn at any time in the browser settings or via the cookie banner.

  • The retention period for cookies may not exceed thirteen (13) months.

ARTICLE 7: ENTRY INTO FORCE – AMENDMENT OF THE TERMS AND CONDITIONS

 

These Terms and Conditions apply for the entire duration of use of the Site.

 

The Publisher reserves the right to modify these Terms and Conditions at any time. Users will be informed of any modifications through their online publication.

 

The most recent version of the Terms and Conditions available online shall prevail, where applicable, over any previous version.

 

 

ARTICLE 8: DISCLAIMER

 

The information available on the Site is provided for informational purposes only. While we strive to ensure its accuracy and regular updates, we do not guarantee its completeness or correctness.

 

The Publisher of the Site shall not be held liable for any direct or indirect damages resulting from the use of the Site or the information published on it.

ARTICLE 9: FORCE MAJEURE

Any event beyond the control of the Purpose-Driven Company, against which it could not reasonably have been protected, shall constitute a case of force majeure and, as such, suspend the obligations of the parties. Such events include, but are not limited to: a strike or technical failure (electricity suppliers, telecommunications operators, Internet or hosting providers, registrars, etc.), an interruption in the supply of energy (such as electricity), or a failure in the electronic communication network on which the Purpose-Driven Company depends and/or any substitute networks.

 

The Purpose-Driven Company shall not be held liable, nor considered to have failed in its obligations under these Terms and Conditions, for any non-performance resulting from a case of force majeure as defined by French law and jurisprudence, provided that it notifies the other party thereof and makes every effort to minimize the damage and to resume the performance of its obligations as soon as the case of force majeure ceases.

 

 

ARTICLE 10: ENTIRE AGREEMENT

 

The provisions of these Terms and Conditions constitute the entire agreement between the Users and the Purpose-Driven Company. They take precedence over any proposal, correspondence exchanged before or after the conclusion hereof, as well as over any other provision contained in documents exchanged between the parties relating to the subject matter of these Terms and Conditions, unless an amendment is duly signed by the authorized representatives of both parties.

 

 

ARTICLE 11: NON-WAIVER

 

The fact that one of the parties to these Terms and Conditions has not required the application of any provision, whether permanently or temporarily, shall in no case be considered a waiver of that party’s rights arising from said provision.

ARTICLE 12: SEVERABILITY

 

If one or more provisions of these Terms and Conditions are deemed invalid or declared as such pursuant to a law, regulation, or a final decision of a competent court, the remaining provisions of these Terms and Conditions shall retain their full force and effect.

 

Where applicable, the Purpose-Driven Company undertakes to immediately delete and replace the said clause with a legally valid one.

ARTICLE 13: HEADINGS

 

In case of interpretation difficulties between headings and the body of any article/clauses, headings shall be deemed not written.

 

 

ARTICLE 14: JURISDICTION – GOVERNING LAW

 

These Terms and Conditions are governed by French law.

 

In the event of a dispute arising from the interpretation and/or execution of, or in connection with, these Terms and Conditions, the parties agree to make every effort to resolve the dispute amicably.

 

Thus, in the event of a dispute between a User and the Purpose-Driven Company, the parties agree to negotiate in good faith to reach a settlement. If the parties fail to resolve the dispute after at least thirty (30) business days of negotiations, the dispute shall be brought before the court having exclusive jurisdiction.

 

All disputes, in particular those relating to the validity, performance, interpretation, and/or termination of these Terms and Conditions, shall fall under the exclusive jurisdiction of the courts of Paris, unless mandatory procedural rules provide otherwise.

 

If any part of this article is deemed unenforceable, the remaining provisions shall continue to have full force and effect and shall be interpreted and applied as if the unenforceable part were not included herein.
